PANTEGO ECONOMIC DEVELOPMENT CORPORATION, AN ECONOMIC DEVELOPMENT SALES TAX CORPORATION

The Pantego Economic Development Corporation hereby gives notice, pursuant to the Texas Local Government Code, Sec. 505.160, that the Corporation has adopted and designated, as projects of the Corporation, the following:

1.As a project of the Corporation, land, buildings, equipment, facilities, expenditures, targeted infrastructure, and improvements found by the corporation's board of directors to promote new or expanded business development. The estimated amount of expenditures for such type of general project in fiscal year 2016-2017 is$30,000.

2.As a project of the Corporation, land, buildings, equipment, facilities, and improvements found by the board of directors to be required or suitable for use for professional and amateur sports, including children's sports, athletic, entertainment, tourist, convention, and public park purposes and events, including stadiums, ballparks, auditoriums, amphitheaters, concert halls, parks and park facilities, open space improvements, museums, exhibition facilities, and related store, restaurant, concession, and automobile parking facilities, related area transportation facilities, and related roads, streets, and water and sewer facilities, and other related improvements that enhance any of the items described herewith. The estimated amount of expenditures for such type of general project in fiscal year 2016-2017 is$150,000.

The Pantego Development Corporation will conduct a public hearing to solicit citizen input regarding the proposed projects and type of general projects identified and described above. The public hearing will be held at the Pantego Town Hall, 1614 S. Bowen Road, Pantego, Texas, on Wednesday, September 14, 2016 at 7:00 p.m. Interested citizens are encouraged to attend and offer their comments.

The Town of Pantego will hold a Public Hearing to discuss the following proposed variance of a residential property:

That Chapter 14, Zoning, of the Code of Ordinances of the Town of Pantego, Texas is hereby amended by adding the following definition in Article 14.02, Zoning Ordinance; Section 14.02.052, Definitions:

Credit Access Business. A financial institution that is also a credit services organization that obtains for a consumer or assists a consumer in obtaining an extension of consumer credit in the form of a deferred presentment transaction or a motor vehicle title loan.

And is hereby amended by adding the following subsection of Section 14.02.451 Use Regulations of Article 14.02, Zoning Ordinance to read as follows:

(A) Any credit access business seeking a certificate of occupancy after March 30th, 2016 must be located at least 1,000 feet from any other credit access business.

(B) The distance of 1,000 feet as stated in subsection (A) above, shall be measured in a direct line as the crow flies from the main customer entrance of each credit access business, without regard to property lines, streets, walkways, walls or any other obstruction.

PENALTY: Any person, firm, or corporation who violates, disobeys, omits, neglects, or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined at the maximum amount allowed by governing Texas law.

EFFECTIVE DATE: This ordinance shall be in full force and effect from and after its passage and publication as provided by law, and it is so ordained.
