TEXAS COMMISSION ON ENVIRONMENTAL QUALITY

NOTICE OF AN APPLICATION

FOR A WATER USE PERMIT

APPLICATION NO. 13199

City of Dalworthington Gardens has applied for a Water Use Permit maintain an existing reservoir on an unnamed tributary of Rush Creek, Trinity River Basin for recreational purposes in Tarrant County. The application does not request a new appropriation of water. More information on the application and how to participate in the permitting process is given below.

<B>APPLICATION.<$> City of Dalworthington Gardens, 2600 Roosevelt Drive, Dalworthington Gardens, TX 76106, Applicant, has applied to the Texas Commission on Environmental Quality (TCEQ) for a Water Use Permit pursuant to Texas Water Code (TWC) §§ 11.121 and TCEQ Rules Title 30 Texas Administrative Code (TAC) §§ 295.1, et seq. Notice is being published and mailed to the water rights holders of record in the Trinity River Basin pursuant to Title 30 TAC § 295.151, and is being mailed to the Northern Trinity Groundwater Conservation District Pursuant to TWC § 11.132(c).

City of Dalworthington Gardens seeks authorization to maintain a dam and reservoir with a capacity of 81.2 acre-feet of water on an unnamed tributary of Rush Creek, tributary of Village Creek Trinity River Basin, for recreational purposes in Tarrant County.

A point on the centerline of the dam is located at Latitude 32.703732° N and Longitude 97.159320° W.

Applicant has proposed to use groundwater from the Trinity Aquifer to maintain the reservoir.

Applicant request to discharge a maximum of 585.4 acre-feet per year into the reservoir at a maximum discharge rate of 0.81 cfs (365gpm) to maintain the reservoir. at an elevation of 561.3 msl.

The application and partial fees were received on June 4, 2015. Additional information and fees were received on November 28, 2016 and January 09, 2017. The application was declared administratively complete and filed with the Office of the Chief Clerk on January 12, 2017.

The Executive Director has completed the technical review of the application and prepared a draft permit. The draft permit, if granted, would contain special conditions including, but not limited to maintaining the reservoir full with groundwater and providing a means to pass all inflows of state water downstream. The application, technical memoranda, and Executive Director's draft permit are available for viewing and copying at the Office of the Chief Clerk, 12100 Park 35 Circle, Bldg. F., Austin, TX 78753.

<B>PUBLIC COMMENT / PUBLIC MEETING.<$> Written public comments and requests for a public meeting should be submitted to the Office of Chief Clerk, at the address provided in the information section below, within 30 days of the date of newspaper publication of the notice. A public meeting is intended for the taking of public comment, and is not a contested case hearing. A public meeting will be held if the Executive Director determines that there is a significant degree of public interest in the application.

<B>CONTESTED CASE HEARING.<$> The TCEQ may grant a contested case hearing on this application if a written hearing request is filed within 30 days from the date of newspaper publication of this notice. The Executive Director may approve the application unless a written request for a contested case hearing is filed within 30 days after newspaper publication of this notice.

A cashier’s check or acceptable bidder’s bond payable to the City of Bedford, Texas in the amount of not less than 5% of the largest possible total for the bid submitted, must accompany the bid.

In the case of ambiguity or lack of clearness in the prices of the proposal, the City reserves the right to accept the most advantageous contract thereof to the City, or to reject the proposal.

The City reserves the right to reject any or all bids and waive any or all informalities. No bid may be withdrawn until the expiration of ninety-days from the date the bids are opened.
